Tips to Unfreeze a Bank Account Frozen by Cyber Cell
When your bank account is frozen by the Cyber Cell, there are three primary options available to you for unfreezing it:
1. Submit a Representation to the Bank and Cyber Cell
The first option involves submitting a representation to both the bank and the Cyber Cell. You will need to provide all transaction-related documents that prove the legitimacy of your transactions and that you have not engaged in any cybercrime. This representation can be submitted via mail or post.
When to Use This Option:
- Use this option when the amount in your bank account is minimal, and you prefer to avoid legal proceedings.
- Even if this method only provides relief in about 10-20% of cases, it is worth trying since there is no harm in submitting the representation.
- This approach demonstrates your cooperation in the investigation, reducing the chances of legal action against you based on non-cooperation.
2. Communicate with the Cyber Cell Investigation Officer
The second option is to communicate directly with the Cyber Cell investigation officer. Send them the relevant documents and, if necessary, visit the Cyber Cell office if you receive a notice under Section 41A or 160. If you are unable or unwilling to visit in person, you can seek assistance from a good cyber advocate.
When to Use This Option:
- When you have sufficient evidence to support the legitimacy of your transactions.
- If the disputed amount is manageable, you can negotiate with the Cyber Cell officer.

Resolving the issue through the Cyber Cell often involves paying the disputed amount. The officer will facilitate an agreement between both parties and send a No Objection Certificate (NOC) to the bank, instructing them to unfreeze your account under Section 91 of the CrPC.

3. Legal Action through Court
If the first two options do not resolve the issue, or if the disputed amount is significant and you do not wish to pay it, you should consider taking legal action through the court.
Steps to Take Legal Action:
- File an application under Sections 451 and 457 of the CrPC in the magistrate court.
- Alternatively, you can file a writ petition in the High Court.
When to Use This Option:
- When you have substantial evidence to prove the legitimacy of your transactions.
- If you seek a legal remedy and want a court order to unfreeze your account.
